Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Traice ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

Traice is a community-powered mobile application that enables users to:

  • Report sightings of ICE (Immigration and Customs Enforcement) activity
  • Receive alerts about nearby sightings
  • Corroborate sightings reported by others

The Service is designed to help communities stay informed and safe.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

4. User Accounts

4.1 Registration

To use certain features, you must create an account using a valid email address. You agree to:

  • Provide accurate registration information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized account access

4.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use Policy

5.1 You Agree To

  • Use the Service only for its intended purpose
  • Submit only truthful and accurate sighting reports
  • Respect the safety and privacy of others
  • Comply with all applicable laws

5.2 You Agree Not To

  • Submit false, misleading, or malicious reports
  • Use the Service to harass, threaten, or harm others
  • Attempt to access accounts or data belonging to others
  • Interfere with or disrupt the Service
  • Use the Service for any illegal purpose
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Service without permission

5.3 Consequences

Violations may result in:

  • Content removal
  • Account suspension or termination
  • Legal action where appropriate

6. User Content

6.1 Your Content

You retain ownership of content you submit (sighting reports, photos). By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content within the Service.

6.2 Content Responsibility

You are solely responsible for content you submit. We do not verify the accuracy of sighting reports and are not liable for inaccurate information.

6.3 Content Removal

We may remove content that violates these Terms or is reported as inaccurate.

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, and code, is owned by Traice and protected by intellectual property laws.

7.2 Your License

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

8. Disclaimers

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee of Accuracy

WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF SIGHTING REPORTS. REPORTS ARE USER-SUBMITTED AND MAY CONTAIN ERRORS OR INACCURACIES.

8.3 No Legal Advice

THE SERVICE DOES NOT PROVIDE LEGAL ADVICE. FOR LEGAL CONCERNS, CONSULT A QUALIFIED ATTORNEY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAICE SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR GOODWILL
  • DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • DAMAGES RESULTING FROM USER-SUBMITTED CONTENT

OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

10. Indemnification

You agree to indemnify and hold harmless Traice from claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Minnesota, USA.

11.2 Informal Resolution

Before filing a formal dispute, you agree to contact us at [email protected] to attempt informal resolution.

11.3 Venue

Any legal action shall be brought in the courts of Minnesota.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes through the app. Continued use after changes constitutes acceptance.

13. General Provisions

13.1 Entire Agreement

These Terms constitute the entire agreement between you and Traice regarding the Service.

13.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

13.3 No Waiver

Failure to enforce any provision does not waive our right to enforce it later.
